The course focuses on the main institutions of public economic law, also considered in a historical context, in order to provide an accurate knowledge of their functioning and a capacity for critical understanding.

Learning Objectives
Knowledge of the main institutions of public economic law, with regard both to the origin and to the historical evolution, and to the current structure, as influenced by the European legal system.
Skill to face the main issues concerning economic Constitution, first of all in identifying the main regulatory framework; skill to interpretate and coordinate the legislation and to place it in the legal and economic context.
Critical understanding of the main characteristics of the public law of the economy, of its histories and problematic aspects.
Prerequisites
It's recommended a good knowledge of constitutional law; administrative law and of the law of the European Union.
Teaching Methods
The course is based on lectures. Students are requested to participate in discussions. It will be planned the organization of some conferences and / or seminars on current issues related to the subject of the course.
Class attendance is recommended.
Further information
In order to attend the course, students shall subscribe to the MOODLE Platform by the first week of lessons.
The attendance of the registered students will be verified by roll call on a random basis.
Type of Assessment
The oral examination is aimed at verifying the knowledge and the critical comprehension of the main institutions of public economic law
The oral exam consists on 3 questions: the firs is focused on a general institute, the second on a more detailed institute, the third on the case law.
The evaluation is sufficient if the answers are fully sufficient and there are no serious mistakes or gaps.
The evaluation will be excellent if all three questions will be treated exhaustively with reference also to the relevant jurisprudence and the
constitutional context. The descriptive knowledge, more or less extensive but without critical analysis or reference to the case law principles can determine a sufficient evaluation but unlikely above 24/30.
Course program
In its first part, the course will fugues on the main aspects of the Italian economic constitution, especially considering the its historical evolution and all the requirements deriving from the European legal system.
The main topics will be: economic regulation; public service in national and European law; public goods; markets; the european principle of non- discrimination.
The second part of the course will be dedicated to analyze those topics through the analysis of cases and jurisprudential materials.
Particular attention will be paid to some topical issues. To this end, meetings and seminars will be organized together with other professors, managers and public administrators.
